Rugby Borough Council will have to pay legal costs to Bloor Homes, after ‘acting unreasonably’ by refusing an application to build 80 homes in Wolston village.
The council refused the application on the grounds of lack of affordable homes, which it then removed as it could not back this claim up, and also that harm would be done to a nearby grade II Iisted building, which was criticised by Planning inspector Graham Dudley who said any harm done would be outweighed by the benefits the development would bring.
Mr Dudley’s report noted that Bloor Homes had the unnecessary expense of the inquiry due to unreasonable behaviour therefore a full award of costs is justified.
The decision means that permission has been granted to build 80 homes at the site, on School Street, Wolston.
