A jury has failed to reach a verdict regarding the case of Noshad Hussain, accused of sexual activity with an underage girl. 
 
Hussain, 22, from Wellington, has denied all charges of four counts of sexual activity with the girl, who cannot be named for legal reasons, between September 2007 and September 2008. 
 
Hussain was cleared earlier in the trial on a count of facilitating child prostitution.
 
After nearly ten hours of deliberations, Judge Michael Challinor sent the jury home after failing to reach a verdict. The Judge has now ordered prosecuting counsel to submit a dossier on their reasoning for seeking a retrial and if it will be in public interest. 
 
Hussain has been bailed until the hearing.
