Derek Pye sees appeal of part of his Arbitration Award dismissed and his original award upheld by Lord Glennie in the Scottish Outer House of the Court of Session.
This the first case to be heard under the new Arbitration (Scotland) Act 2010 and is also interesting because it concerns the important issue as to burden of proof under the not often litigated NEC3 contract.
