The Hague Convention on the International Protection of Adults and its implementation into the Private International Law of England and Wales

This article considers the changes to the Private International Law of England and Wales by virtue of Schedule 3 of the Mental Capacity Act 2005, which implements the Hague Convention on the International Protection of Adults into domestic law. It also considers the difficulties presented by the UK’s ratification of the Convention with respect to Scotland but not England and Wales.
