Court of Appeal judgment on improper planning prosecutions


Last week the Court of Appeal handed down judgment in the case of Wokingham Borough Council v Scott and others, giving important guidance on planning prosecutions and, in particular:

  • The relevance of POCA and confiscation in planning prosecutions;
  • The importance of the proper application of the Code for Crown Prosecutors;
  • The consequences of representations made by Councillors and planning officers to subsequent prosecutions; and
  • Abuse of process and improper motivations.

The case is also important for highlighting the role of Councillor’s personal emails and disclosure.  You can view the full judgment here.
