No5 Barristers Stop Council in its Tracks
Mr Cahill QC advised Hereford City Council which objected to Herefordshire County Council’s decision to relocate the city’s outdoor market to the proposed site, 100 metres from the existing Butter Market.
Upon this advice, Mr Leigh acted on behalf of the Butter Market Trading Association, who strongly opposed the decision, claiming that it would have a significant impact on trade.
Commenting on the case, Kevin Leigh said: “The main issue here is whether the Butter Market Trading Association can demonstrate that the proposed relocation would interfere with the ‘rights, powers or privileges’ that they enjoy as market traders.”
The High Court Judge granted an injunction against Herefordshire County Council relocating the market until the case is concluded. No application has so far been made by the Council to overturn the decision.
