THE INTERNAL MANAGEMENT OF DIFFICULT DECISION MAKING: Reports, Committees and a Defensible Paper Trail

The intention of this paper is to examine the nature of challenges by way of Judicial Review. In essence the exercise is fundamentally a paper based process which will consider the audit trail held by the public body to explain the decisions that have been taken and perhaps more crucially the reasons why those decisions were made.

In this article I highlighted that the Act is limited in scope and did not offer much guidance on how the Act is to be interpreted and applied. There has also (until my case below) been no judicial guidance on the correct application. The Magistrates Court Guide provided little assistance either....
