Experience as counsel
Russell’s main field of practice is employment law although he also acts in a number of commercial matters (of particular relevance in the sporting field – agency and disputes involving clubs and unincorporated associations) and, to a lesser extent, in personal injury claims.
In the employment field he has acted for a professional football team and a Formula 1 team defending claims in employment tribunals, including claims for unfair and wrongful dismissal. He has acted in claims for injunctions and compensation where members have claimed to have been wrongfully excluded from clubs. In the personal injury field he has been instructed where school pupils have claimed that their sporting injuries have been attributable to a lack of supervision or the absence of suitable equipment and where participants in recreational activities (bouncy castles, wall fly jumping) have alleged a lack of supervision or sufficient warning of the inherent dangers.
Russell has more than 25 years’ experience as a barrister across a wide spectrum of practice areas and he is always interested to act in cases which require multi-disciplinary expertise and knowledge.
He has practical (and in most cases, recent) experience of rugby, triathlon, marathon, mountain walking, cycling (road and off road), skiing, scuba diving, fishing and a variety of racket sports.
Notwithstanding his post-sporting physique Russell likes to consider that he remains a man fleet of foot.
Experience as a neutral
Russell is a Fellow of the Chartered Institute of Arbitrators through both the arbitration and the mediation routes. In 2009 he was awarded a Post Graduate Diploma in International Mediation (with distinction) by London University. He is a member of the Oxford Mediation Group and the International Mediation Institute.
Russell has been an active mediator since 2007 with a high success rate; more than 70% of mediations he has conducted have settled at the mediation or shortly thereafter. In the sporting field, he has successfully mediated a dispute between an international coach and a premiership rugby club and a dispute between the coach and manager and a midlands-based professional football club.
