Richard Jones QC - Banking, Finance and Financial Regulation
Richard has wide experience in this field.
He has particular interest and experience in money laundering insofar as it affects legal and accountancy professionals. He has contributed to the Practitioner's Guide to UK Money Laundering Law and Regulation.
He has extensive experience of disputes affecting financial services professionals and consumers and in particular claims for breach of duty by IFAs. He is currently acting in several cases involving Keydata, and Senior Life Settlements.
He advises upon the relationships of intermediaries with the FSA, and acted for the FSA in the Semperian case (failure to obtain FSA authorisation to change of control in complex restructuring).
He has particular expertise in the area of confidential information in the private equity sector (Vercoe v Rutland  EWHC 424 (Ch)) and has advised extensively in respect of such disputes.
Richard has also been engaged in disputes between HMRC and taxpayers seeking to recover VAT input tax, a developing area.
Mirror Group Pensions case (acting for Bank of America) in Maxwell related litigation involving Credit Suisse and liquidators of Bishopsgate Investments (trial lasted 10 months)
Bank of America – trial involving interpretation of promissory notes plus dealing with case in Court of Appeal
Sepoong v Formula One (dispute involving financial instruments produced by Ecclestone for Formula One in Korea)
Advising various banks on issues such as : terrorist legislation; obtaining recovery of monies transferred out of the jurisdiction in error
Advising General Counsel of Nomura on potential claims arising out of credit crunch and issues related to FSA approach; consequences of recent decisions on privilege within corporations for protecting correspondence against disclosure in such circumstances
Advice to Edward Jones (Canary Wharf UK) on product mis-selling and compliance issues
Irish Life – various actions relating to compliance issues and mis-selling of pension and other products
Advice relating to breach of duty on the part of accountants in respect of misuse of pension products
Richard was engaged in the market abuse case involving AIT plc; and has advised on and appeared in a number of notable cases.
