Ian Brownhill - Public Law

INTRODUCTION

Best known for his work in criminal justice law, Ian has expanded a multifaceted public law practice at No5 Chambers. Despite being known primarily for work relating to the police, prisons and the Courts, Ian has more recently expanded his public law practice.

Ian primarily acts for Claimants but is increasingly sought after by Local Authorities. One particular area of expertise is in using the case stated procedure, challenging decisions of the Magistrates’ Court in the High Court.

Since 2014, Ian has had back to back, harassment injunction cases in the High Court. He acts for both the persons seeking and responding to injunctions. 

TYPE OF WORK UNDERTAKEN

The vast majority of public law work that Ian undertakes is either related to restriction of liberty, or procedural fairness. Ian is always to have an initial no obligation telephone conversation before accepting instructions and will often provide telephone advice for free. Ian is a seasoned ‘out of hours’ Counsel and has an impressive record in obtaining interim relief in the evening and at weekends.

Ian’s present case load includes:

Prison law judicial reviews, in particular: challenges to Parole Board decisions and delay. Findings of Independent Adjudicators and sentencing calculation.

Police law judicial reviews, in particular: challenges to cautions and bail decisions.

Community care, in particular: section 17 child in need assessments, Zambrano carers, NASS support.

Mental health, in particular: the legality of detaining persons for treatment.

Public authorities and social media: harassment cases relating to blogs and twitter. The rights of public officials to express themselves in public. 

Rehabilitation of offenders: matters relating to CRB / DBS checks (especially the contents of DBS checks and appeals to the Independent Monitor). 

SPECIFIC EXPERIENCE & CLIENTS

Ian regularly appears in cases relating to harassment in the High Court. Virtually all of those cases have, a ‘public interest’ element to them. Ian is also increasingly sought after to defend High Court allegations of contempt. 

RECENT WORK

C v DPP, - Judicial review of decision to discontinue a prosecution against a prisoner. Acted for the prisoner led by Rebecca Trowler QC.

Various Police Officers v H – High Court Injunction application against police corruption blogger. Acted for the blogger.

PM v Independent Monitor – Judicial review of decision of Independent Monitor to allow information to appear on a health worker’s DBS/CRB check which contradicted the findings of a Coroner’s Court.

I v A Police Force – Judicial review of decision to keep alleged fraudster on police bail for a number of years. Permission secured as junior alone, led ultimately by Judith Farbey QC. 

CA v A Local Authority – Judicial review and interim injunction to provide support to failed asylum seeker.

A Public School v S – High Court Injunction against former staff member harassing staff of major public school. Acted for school.  

REPORTED CASES

R. (on the application of Galiazia) v Governor of Hewell Prison [2014] EWHC 3427 (Admin); [2015] 1 Cr. App. R. (S.) 13[2015] A.C.D. 18 whether an offender had been lawfully recalled to prison for breach of licence, notwithstanding the fact that he had spent more time remanded in custody prior to sentence than the length of the sentence imposed. Permission secured as junior alone following oral hearing, led in final hearing by Judith Farbey QC.

R. (on the application of H) v Chelmsford Magistrates' Court [2014] EWHC 2799 (Admin) – Judicial review of Magistrates’ Court’s decision not to delete a person from the sex offenders register.
