Brian Dean - Crime

Chambers and Partners – the leading, independent legal directory – describes Brian Dean in the following terms,

‘... observers praise Brian Dean as, “one of the hottest performers on the circuit.” Instructed in high profile cases, he is, “the barrister you need to instruct if you want no stone left unturned.”’

Brian Dean both defends and prosecutes serious cases in the Crown Court, including multiple murder, attempted murder, manslaughter, gross negligence manslaughter, very high value and complex fraud, large-scale drugs importations, organised crime, gang shootings and related violence, Misconduct in Public Office and corruption, and the most serious types of sexual allegations, such as large scale historic abuse in care homes and children’s homes, and involving many victims over many years. He has conducted numerous high profile cases, many of which have been reported nationally, and continues to do so.

He is regularly instructed by the Police Federation of England and Wales to defend police officers charged with criminal offences. He is also instructed by numerous leading defence solicitors, by the Complex Casework Unit of the Crown Prosecution Service (to prosecute some of its most difficult and challenging cases) and, increasingly, accepts instructions direct from members of the public under the Bar’s Direct Access scheme (please contact his clerks to discuss). He has also been instructed by a number of Chief Constables, including by West Midlands Police, to advise and represent on criminal and quasi-criminal issues.

He has considerable experience of managing and conducting Very High Cost Cases and in the last 2 years – in addition to his usual heavy and diverse workload – has defended in 3 such cases as follows; the defence of a company director in a £10million fraud involving 50,000 pages of evidence, the defence of the lead defendant of 12 defendants in a £20million MTIC VAT fraud involving 20,000 pages of evidence, and the defence of the lead defendant of 10 defendants in a £3million fraud involving 30,000 pages of evidence. During the same period he has prepared the defence of a surveyor charged with a £3million fraud in a case involving 10,000 pages of evidence and the defence of a man accused of participation in an illegal sex ring (with 8 co-defendants), involving 20,000 pages of evidence.

He has extensive experience of handling expert witnesses (including in banking, computing and accounting), dealing with complex scientific and medical evidence, and of dealing with sensitive and difficult disclosure issues.

Over the years he has lectured other barristers, solicitors, local authorities, bankers, accountants, company secretaries, company directors, the CPS, Counter-Terrorist Officers and other police officers on matters as diverse as the Bribery Act, the likely changes to the FSA and our national regime of financial regulation following the change of government, the Enterprise Act and the OFT’s approach to prosecuting criminal cartels, the Fraud Act, inferences from silence, accomplice witnesses (the regime under The Serious and Organised Crime and Police Act 2005), disclosure in sexual offences and mentally disordered offenders.
