Alex regularly defends cases brought by the Environment Agency, the Department for Business Enterprise and Regulatory Reform, The Health and Safety Executive, the Information Commissioner as well as cases brought by Local Authorities for breaches of Building Regulations, Food Safety Legislation and Trading Standards. He also undertakes insurance funded defence work for motoring offences at all levels.

He has a good understanding of Fire Safety regulation and both prosecutes and defends cases involving breaches of the Regulatory Reform (Fire Safety) Order 2005.
Alex defends cases brought by Local Authorities on behalf of Copyright and Trademark Holders in both the Magistrates' and Crown Courts and has a wide experience of defending Trademark infringement cases. He is currently instructed in 2 separate cases involving Defendants accused of running bit torrent file sharing websites.

He has a thorough understanding of the confiscation legislation and often undertakes restraint proceedings in the High Court on behalf of both Defendants and third parties.

Alex was Junior Defence Counsel for John Early in the Court of Appeal, the leading case emanating from the London City Bond cases as featured on the BBC's Panorama. Reported at [2003] 1 CrAppR 19.

He lectures on Abuse of Process in Regulatory Cases and has successfully applied those principles in a number of his cases.

NOTABLE CASES

R v AE [2010] - Defendant charged with conspiracy to defraud arising from the operation of his bittorrent website Oink. The first criminal trial of a bittorrent site in the UK. Unanimous acquittal.

Surrey CC v M Ltd [2009] - Defendant company accused of producing unfit tractor trailers contrary to the Trades Descriptions Act 1968. No case to answer.

Derbyshire Fire and Rescue Service v C [2009] - Successful prosecution of a landlord under the Regulatory Refore (Fire Safety) Order 2005

R v MN [2009] - Death by Dangerous Driving involing automitism following syncope episode and amnesia.

R (HSE) v JCD Limited [2009] - Company prosecuted for breaches of Manual Handling Regulations following a Voluntary Arrangement under the Insolvency Act 1986. Nominal Fine.

DEBRR v M [2008] - Prosecution under section 360 Insolvency Act 1986. Suspended sentence.

Cardiff CC v H [2008] - Trademarks Defendant. Suspended sentence with subsequent confiscation stayed as an abuse of process.

Environment Agency v M [2008] - Prosecution for breaches of s33 EPA 1990 brought by the Environment Agency Wales following the alleged disposal of asbestos and other controlled waste at an industrial site near Hereford. Prosecution offered no evidence to all charges prior to an Abuse of Process application.

North-West Leicestershire BC v V [2008] - Lorry Driver prosecuted under section 33 HSWA 1974 following a fatal accident. £1000 fine in the Crown Court.

Cardiff CC v K [2007] - Trademarks Defendant. Instructed post conviction in relation to confiscation proceedings.

Walsall BC v V [2007] - Prosecution for the making of False Statements under the Trades Descriptions Act 1968

DTI v D [2007] - Company Director issuing over £500,000 worth of false invoices on a factoring account.

R (HSE) v M [2007] - joint CPS and HSE prosecution of a digger driver for manslaughter. Defendant acquitted.

DTI v WK [2006] - DTI prosecution under section 11 CDDA 1986. Defendant conditionally discharged.

R (HSE) v T ltd [2006] - Breach of Provision and Use of Work Equipment Regulations 1998.

Herefordshire DC v S+A [2005] - Prosecution of a multinational company for breaches of the Building Regulations in a newly constructed temporary workers boarding facility. Prosecution offered no evidence following service of the Defence Case Statement and Abuse of Process Skeleton Argument.

DEFRA v Hiden [2004] - prosecution under regulation 19 of the Environmental Impact Assessment (Uncultivated Land and Semi-Natural Areas) Regulations 2001 for allowing Hogweed to develop. Defendant conditionally discharged.

DTI v B [2004] - Fraudulent trading prosecution, suspended sentence due to ill health.

Hereford and Worcester Fire Service v D [2003] - Prosecution of a hotel manager under the Fire Precautions Act 1971. Acquitted by the District Judge on the interpretation of 'occupier' under the 1971 Act.

Post Office v P [2003] - Recovery of 500,000 euro for the Post Office under the Proceeds of Crime Act 2002.

Information Commissioner v HP [2003] - Breach of the Data Protection Act by mother seeking information about her ex-husband for CSA purposes. Prosecution offered no evidence following service of the Defence Case Statement.
