Richard Adkinson Family

Richard has experience from pre-issue advice to trial of disputes over the ownership of land (i.e. trusts of land claims) between cohabitants and where a third part asserts and interest in the context of trusts, estoppel and undue influence. He has acted in high value cases, cases involving property situated overseas and in both the High and county court. He has lectured solicitors on the law and practice of trusts of land.

Cases of note include:
• Acting for a claimant former cohabitant who sought to set aside the transfer of her former partner to her husband on the grounds of undue influence. He had subsequently transferred it to a company of which he was sole director and shareholder. The application was made at the point that the company had been wound up and was trying to transfer the house back to him as an in specie dividend;
• A case of a former cohabitant where the property was in the name of the brother of her former partner;
• He acted for a claimant former cohabitant in a case where there were 3 jointly owned properties, 2 of which were overseas and where the total value of the properties was c.£950,000.

Further he has experience of claims for widows, children and others who have not been adequately provided for in a will or administration. Richard has experience of mediation in all of these sorts of claims.
